General terms and conditions

DEFINITIONS

Nordic Hotels in Stockholm AB, 556571-9829, referred to below as Nordic.

The term…

...facility is defined as all hotel rooms, meeting venues, restaurants, bars, relaxation room, garage and other premises and areas which, including equipment, are available to Nordic’s guests.

...arrangement is defined as a situation where premises and/or areas are made available with or without lodging and/or food, e.g., for meetings, events, conferences, lunches, dinners, and visits to ABSOLUT ICEBAR STOCKHOLM.

...ordering party is defined as the person – legal or physical – who is obligated to pay for the arrangement or the stay at the hotel.

...value of the order is defined as the agreed upon price for the entire order, or the total of the ordered number of participants, multiplied by the agreed price per participant per day, and the price of specially ordered services.

...booking and order are defined in the same manner in these terms and conditions.

... individual hotel rooms are defined as hotel rooms not included in an arrangement or a group.

...group is defined here as when an ordering party has booked a minimum of 10 rooms for 10 or more participants, at the same time, and where the booking only includes room and/or meal.

...guest is defined here as the person who participates in an arrangement, or who lives or stays at the facility.

...Kr or SEK refers to Swedish Crowns.

...in writing is defined as by letter, fax or e-mail.

ORDER/BOOKING

The order must be placed orally or in writing.
Nordic has the right, as a condition for the order
a.  to conduct and evaluate the result of a credit check
b.  to request a security deposit or payment in advance
c. to require a security payment for no-show by asking the ordering party or the guest to provide complete account information, which means that the ordering party or the guest approves the withdrawal.

If the above terms and conditions are not approved by Nordic within the indicated time, Nordic will determine whether the order shall be confirmed.

Special requests

If the ordering party has a special request regarding, for example, food, pets, signs or presentations of his own trademark, receiving service, technology or music, security arrangements, exclusivity in connection with arrangements, etc., this shall be mentioned at the time of the order. Nordic shall then decide if the request can be met and shall provide information about any terms and costs connected to it.

Confirmation

An order becomes binding when it has been confirmed by Nordic.

Nordic shall provide written confirmation of an order for an arrangement or a group. Other orders are confirmed orally and, if the ordering party prefers, orally or in writing, with any applicable booking number information.

PRICES

All prices include VAT unless otherwise indicated.
All room prices are indicated for a certain number of people. Nordic has the right to apply a surcharge for every additional person in the hotel room.

Offered prices

The prices that Nordic provides upon request or in connection with an order, only apply to this specific occasion, unless otherwise agreed, and for the indicated days, seasons or periods, as well as the number of hotel rooms, premises and/or persons. If the ordering party changes the order in itself or the conditions in some manner, Nordic shall not be bound to the offered price, but shall have the right to provide a new price.

Lowest price guarantee

Nordic provides a lowest-price-guarantee for individual hotel rooms when they are book on Nordic’s websites. The following terms and conditions shall apply:
a) The booking must be made via www.nordiclighthotel.se or www.nordicseahotel.se
b) Within 24 hours of the booking, the ordering party must have found a cheaper room for the same hotel, the same room type, the same number of persons, the same arrival date, the same departure date and the same other terms and conditions (e.g., payment terms) on another homepage.
c) Nordic must have received your notice per b) above via email, within 24 hours of the order and no later than 72 hours before your arrival.
d) This guarantee does not apply to bookings/prices that are not available to the public, e.g. agreement prices for businesses and travel agencies, group and conference prices or where the hotel name is not given until after the booking.

Exception for price changes

a) If, based on the order, the cost of delivery increases as a consequence of tax increases, currency devaluation, government decisions or similar circumstances, Nordic shall be entitled to impose surcharges that correspond to the increase in cost.
b) If Nordic makes exceptions for price increases, based on reasons other than that which is mentioned above, Nordic must provide clear information at the time of the booking that price changes may occur.
c) Nordic must inform the ordering party without delay when a surcharge is applied.

PAYMENT

Nordic’s primary rule is that the bill is payable when it is presented.

Responsibility for payments

The ordering party is responsible for all incurred costs for ordered arrangements and/or an individual/group’s stay. If the participants in an arrangement or a group pay something individually, this must be approved by Nordic at least a week before the first day of the arrangement/visit. If participants fail to appear for an arrangement or part of an arrangement or a group, this does not entitle them to a right to reduction in the price.

Method of payment

Payments shall be made in cash or with a bank card. Nordic accepts most regular credit cards (VISA, MasterCard, American Express, Diners Club and JCB), Swedish currency and the most common foreign currencies, based on the list in the hotel reception desk. Nordic does not cash travellers’ cheques. No types of cheques may be used for payment.

Nordic also accepts payment in the form of vouchers or gift cards, in accordance with special agreements.

Invoice

After having performed a credit check, Nordic may accept, at least 8 weeks before the ordering party’s arrival, payment based on invoice for amounts in excess of SEK 5000.00, from companies with their domicile in Sweden, Denmark, Norway, Finland and Iceland. If an agreement has been made regarding payment against an invoice, the ordering party shall make payment in full within 30 days of the invoice date.

Complaints regarding the invoice

Any complaints about an invoice must be received by Nordic within 8 days of the invoice date. The ordering party shall provide a written itemisation of the errors and the nature of the errors. If the ordering party does file a claim within the stipulated period, and does not indicate the nature of the error, the ordering party shall have forfeited his right to a price reduction or similar compensation.

Late payment

If Nordic has not received payment by the due date, Nordic shall have the right to charge the legal reminder fee as well as late interest, at the percentage rate of 2% per month.

Order/booking cancellation

Orders confirmed by Nordic are binding for Nordic and the ordering party. However, see terms and conditions under the heading “Booking/ Order” above.

Cancellation of individual hotel rooms

Individual rooms, which have been booked without cancellation restrictions, may be cancelled until 6:00 PM on the arrival date. If the room is cancelled later than that or if the guest does not arrive (no-show), the ordering party will be charged the price for one day.

Cancellations will be confirmed orally and, if the ordering party wishes, orally or in writing, with information about the cancellation number.

Cancellation of group or arrangement

Nordic’s primary rule is that the ordering party of an arrangement or group may cancel without cost on the condition that:
a. the cancellation is made in writing with Nordic,
b. the cancellation occurs, at the latest, six weeks before the arrival date of the arrangement or the group, and
c. the ordering party can show a written confirmation of the cancellation or has a cancellation number issued by Nordic.

In the event of a cancellation later than six weeks before the first arrival date of the arrangement or the group, the ordering party shall compensate Nordic with 75 percent of the order’s value.

In case of a cancellation later than two weeks before the first arrival date of the arrangement or the group, the ordering party shall compensate Nordic with the entire value of the order.

Depending on the size and type of arrangement or group, other cancellation rules may apply. In these cases, they shall be indicated by Nordic in writing in connection with the confirmation.

Any costs incurred by Nordic as a result of a cancellation shall be paid in full by the ordering party.

Early departure

If a guest, who has booked an individual hotel room, departs early, prior to the confirmed departure date, the guest will be charged for an additional day. In case of early departure in connection with another order, the ordering party will be charged the value of the order in full.

RULES AND REPONSIBILITIES DURING THE VISIT

Guaranteed hotel room

If for some reason Nordic is not able to provide an ordered hotel room, Nordic shall provide a hotel room of corresponding or higher standard at another hotel. If the price of the provided hotel room is higher than Nordic’s confirmed price, Nordic will assume the cost of the difference for one night. Transportation to and from the other hotel and Nordic will be handled and paid for by Nordic.

Delivery and pickup

Buses, automobiles and other vehicles used to deliver and pick up guests at Nordic may only stop for delivering and picking up guests in the designated pickup and delivery zones.

Nordic offers any guest arriving by automobile, parking service directly on arrival, on the condition that the auto keys are left at the reception desk. The guest shall have access to the car 24 hours/day through Nordic’s parking service. The charge for the parking service is based on the applicable price list.

Arrival

Check-in may occur from 2:00 PM on the arrival date. The room is reserved for arrival until 6:00 PM. If a guest expects to arrive late, the guest/ordering party must inform the hotel in advance in order not to risk the room being rented to someone else. The guest/ordering party shall guarantee his/her arrival by leaving a credit card number and he/she is liable for payment of the first night if the guest does not arrive (no-show). For groups and arrangements, please refer to the terms and conditions in the sections, “Ordering/booking”, and “Order/booking cancellation”.

Departure

Checking out shall occur by 12:00 PM on the departure day. When possible, Nordic offers, for a fee, late check-out. If the guest has not checked out within the agreed time, Nordic has the right to charge for one additional day.

Security procedures

When checking in, the guest shall agree to abide by Nordic’s security routines and the instructions that are posted and/or provided by Nordic’s personnel.

Limited responsibility for the property of the ordering party and the guest

Nordic assumes no strict responsibility for property stored in Nordic’s hotel rooms, meeting venues, garage or other premises. When leaving hotel rooms and/or premises used by the guest, it is his/her responsibility to leave them locked. If it can be shown that Nordic or its employees have acted negligently or carelessly and, thus, have been found liable for lost or damaged property, Nordic shall assume responsibility for the lost/damaged property.

Property that has been sent to and received by Nordic and/or which is stored in a storage area locked by Nordic, is the responsibility of Nordic up to a value of SEK 5000.

The ordering party’s and the guest’s responsibility

The ordering party is responsible for any damage caused to the facility by himself/herself, his/her personnel or participants in arrangements or groups, by negligence or carelessness. The ordering party may, at his/her request, inspect the facility before the start of the arrangement.

All rooms contain a safe for the personal use of the guest, and the guest himself/herself is responsible for its contents.

If the ordering party or the guest, wishes to store very valuable possessions in Nordic’s storage areas, e.g., luggage room, he/she must inform Nordic of the value. In case of theft, or a similar incident, Nordic is only liable for damages if Nordic has assumed responsibility for the property in writing.

If a guest causes damage to furnishings, equipment, decorations, ice, sculptures or other interiors, the guest and the ordering party are jointly and severally responsible for compensating Nordic in an amount that corresponds to the repair costs or replacement, as well as any loss of income that occurs as a result of said damage.

If a guest causes an unnecessary visit by the emergency services, the guest and the ordering party are jointly and severally liable for compensating Nordic for any costs incurred.

If Nordic has reasonable cause to believe that a guest is under the influence of alcohol and/or drugs, Nordic has the right to expel said guest from the facility, in accordance with Swedish law. Nordic has the right and the obligation to charge the ordering party for the entire stay.

All forms of prostitution are prohibited based on Swedish law. If Nordic has reasonable cause to suspect that a guest violates this law, Nordic has the right to expel said guest from the facility. Nordic has the same right, if a person uses the facility to conduct activities which can be assumed to damage Nordic’s reputation with customers, the general public or with government agencies.

Inspection

Nordic has the right to gain access to hotel rooms and premises used by the guest, for the purpose of cleaning, inspection, etc.

Broadband

Nordic provides a fixed broadband connection with limited bandwidth, however without firewalls, virus protection or support, in all hotel rooms without extra cost. The guest is responsible for his/her own equipment. If a guest, through negligence or carelessness damages or causes damage to the facility’s computer system, the guest and the ordering party are jointly and severally liable for compensating Nordic for said damage.

SECRECY

The information that has been or will be given to Nordic, based on this agreement or an order, shall be treated confidentially by Nordic, and must not without written permission from the ordering party be forwarded to a third party or be used for any purpose other than for the execution of orders. No reference to the agreement, an order or to the ordering party may be made by Nordic, in advertising or marketing, without written permission from the ordering party.

Photographing and filming, for commercial purposes, in or in connection with the facility, including ABSOLUT ICEBAR STOCKHOLM is prohibited. If Nordic has reasonable cause to suspect the violation of this prohibition, Nordic shall have the right to expel those involved. Violations may also result in compensatory damages and/or fines based on the provisions in the copyright law.

RECORDING PERSONAL INFORMATION

The ordering party and/or the guest shall provide Nordic with personal information, at the time of the order or upon arrival. This is necessary for Nordic’s ability to complete the order. The act of providing the information, also gives Nordic permission to process the information in its marketing and business analysis. The permission also allows Nordic to use the personal information with its cooperation partners.

FORCE MAJEURE

If Nordic is prevented from executing the agreement due to circumstances beyond Nordic’s control, which Nordic reasonably could not have expected when the agreement was made, and the consequences of which, Nordic could not reasonably have avoided or resolved, such as
• strike or lockout
• fire
• essential reductions in deliveries
• war
• natural disaster
• national martial law
• actions decided upon by the Parliament, government or local authorities,
this shall, if it affects the execution of the agreement, constitute the basis for exemption, which shall postpone the time of performance and exclude Nordic from penalties and other legal consequences. If the execution of the agreement is impeded for a period of longer than six (6) months, due to one of the consequences indicated above, Nordic shall have the right, without the obligation to pay compensation, to terminate the agreement in writing.

DISPUTE RESOLUTION, ETC.

In the event of a disputes regarding this agreement, the Swedish Hotel and Restaurant Association’s Disciplinary Offence Board is available to the parties. The parties promise to abide by the Offence Board’s decision. Swedish law applies. In order for any changes or amendments to these General Terms and Conditions to be binding between the parties, they must be in writing and signed.
